Biography

YAEL KOGAN is a dedicated and goal-oriented litigator who thrives on solving complex legal problems. She is committed to protecting her clients’ interests and assisting them with finding durable, creative, and tailored solutions to their legal needs. Yael maintains a broad-based litigation practice with a focus on professional liability, medical negligence, product liability, construction litigation, commercial litigation, and insurance coverage matters. She has represented clients and assisted with matters before various courts and administrative tribunals.

Yael is a member of the Law Society of Ontario and the Toronto Lawyers Association.

Prior to joining Stieber Berlach, Yael gained a wealth of experience working in politics in various positions within the House of Commons and the Senate and articling at a regional law firm in Ottawa.

Yael received a Bachelor of Arts degree in Criminology and Ethics, Society and Law from the University of Toronto and her Juris Doctor from Osgoode Hall Law School, where she was awarded the Neil E. Wood Real Estate Prize and the Osler Future Innovators Award. While in law school, Yael participated in numerous mooting and negotiation competitions, and was a caseworker at the Community & Legal Aid Services Program and the Innocence Project.

Yael is fluent in Russian.

Representative Work

  • Represents Ontario children’s aid societies in proposed class action pertaining to birth alerts.
  • Represents multiple children’s aid societies in litigation alleging that the agency failed to conduct appropriate investigation into alleged mistreatment of children. This includes litigation arising from the Motherisk program at the Hospital for Sick Children.
  • Represents multiple Children’s Aid Societies against allegations of improper investigations
  • Represents mortgage and insurance brokers/agents in negligence claims
  • Represents hospitals and nurses against various allegations of medical negligence
  • Represents construction companies and engineers on allegations of faulty design and installation
  • Represents employers in both civil litigation and applications before the Human Rights Tribunal of Ontario
  • Represents condominium corporations and boards of directors in various litigation matters
  • Represents drivers, vehicle owners and insurers in actions arising out of motor vehicle collisions
  • Represents property occupiers and owners in actions arising out of injuries that occurred on their premises
