Biography

SUKH DIAL is an experienced trial lawyer who practices primarily in personal injury litigation, defending motor vehicle accident, occupiers’ liability and products liability claims. He also handles professional liability and wrongful dismissal claims. Sukh’s understanding of complex legal issues, together with his proactive approach to cases, allows him to obtain favourable outcomes for both insurance companies and their insureds at all stages of litigation, from pre-discovery through to trial.

Sukh has argued before the Ontario Court of Appeal, the Divisional Court and Superior Court of Justice. He has also appeared before the Workplace Safety and Insurance Tribunal. He was called to the Bar in Alberta in 2002 and to the Ontario Bar in 2003.

Sukh is a member of the Canadian Bar Association, the Ontario Bar Association, the Advocates’ Society and the Toronto Lawyers Association. Sukh is currently the firm’s student recruitment co-ordinator.

Representative Work

Gill v. Sivaranjan (2015) – Trial

  • Successfully defended as lead counsel plaintiff’s claim for personal injury arising from a motor vehicle accident
  • Successfully argued plaintiff did not sustain any injuries as a result of the accident
  • Plaintiff’s claim for damages was dismissed

 

Gill v. Sivaranjan (2015) – Threshold Motion

  • Lead counsel in post-trial threshold motion where court concluded the plaintiff did not sustain a permanent serious impairment of an important physical or psychological function as a result of the motor vehicle accident

 

Colangelo v. Peninsula (2013)

  • Successfully represented defendant insurance brokerage at trial as lead counsel. It was alleged that the broker had been negligent, failing to assist the plaintiff in securing appropriate coverage for business equipment

 

Jovanovic v. Hamilton Wentworth Regional Police Services Board et al (2008)

  • Successfully defended ambulance attendants in a claim advanced by plaintiff for damages arising from their alleged negligence and assault, as well as claim for punitive damages
  • Was successful in counterclaim against plaintiff for damages arising from assault on ambulance attendants, resulting in an award of general damages and punitive damages
