Biography

LINETTE KING is an experienced advocate who uses the breadth of her experiences and perspectives to deliver comprehensive litigation solutions for her clients. Linette maintains a broad practice including professional negligence claims (regulated health professionals, engineers, architects, builders and developers), personal injury claims including slip and falls and motor vehicle accidents, defamation claims, class actions, human rights claims, and historical sex abuse claims. Linette has extensive experience representing institutional clients including schools, school boards, condominium corporations, churches, long-term care organizations, and various non-profit organizations.

Linette has advocated for her clients in Small Claims Court, Superior Court, and the Court of Appeal as well as at various administrative and regulatory tribunals.

Before joining the firm Linette worked as a litigator at a national law firm focusing on regulatory prosecution work. Linette also worked as a lawyer at a Toronto legal clinic practicing in tenant-side housing litigation and in partnership with St. Michael’s Hospital as an onsite lawyer in the Health Justice Program.

Representative Work

Appellate Litigation

  • Assisted in the successful appeal of a jurisdiction challenge motion concerning the interpretation of conflict terms in prime contracts and subcontracts in a dispute regarding a major infrastructure development: Black & McDonald Limited v. Eiffage Innovative Canada Inc., 2023 ONCA 91

Class Actions

  • Assisted in the successful resistance of certification on behalf of certain long-term care homes in various proposed class actions and mass torts, including actions arising out of Covid-19 pandemic and allegations of inadequate care in homes: Pugliese v. Chartwell et al, 2024 ONSC 1135

Human Rights

  • Successfully defended a claim of discrimination on the basis of disability against an organizational client concerning their removal of a service dog due to significant weight gain and the deterioration of the dog’s health and welfare: K.P.S. v. National Service Dogs, 2024 HRTO 548
  • Successfully defended a claim of discrimination on the basis of disability against a professional association concerning the actions of their member locksmith in response to a service call on a commercial condominium unit and subsequent complaint from the unit’s owner: Tran v. Windows Bars Ltd. Locksmiths, 2024 HRTO 994

Landlord and Tenant Disputes

  • Successfully represented a tenant in an unlawful eviction matter which engaged issues of abuse of procedure and statutory interpretation: Residences v Bonilla, 2020 CanLII 120582 (ON LTB)

Professional Discipline

  • Successfully represented the professional regulator in contested discipline proceedings concerning a teacher’s inappropriate commentary, management, and discipline of students in his class: Ontario College of Teachers v Matar, 2023 ONOCT 48
