Biography

ALEX VALOVA has experience dealing with complex construction disputes across Canada and the United States. In addition to her time in private practice, Alex spent several years working in-house for a large North American construction company where she dealt with large disputes and contract negotiations. Alex also worked for an agency of the Ontario government responsible for building transit infrastructure and was the lead counsel for construction litigation/disputes on a new major transit project in Toronto. Alex has experience representing clients in various Alternative Dispute Resolution processes such as mediations, referees and combined dispute boards.

In addition to her experience with construction litigation, Alex has experience with professional negligence and commercial disputes. Alex has appeared at all levels of court in Ontario. Alex holds an LLM from Osgoode Hall in Business Law.

Significant Matters

  • Acted for Ontario agency over a complex transit dispute for construction delays involving various contractors.
  • Acted for a construction company in delay and additional cost disputes on windfarm projects in New York State and Texas, United States.
  • Acted for a construction company with respect to various public infrastructure projects including, roads, bridges and tunnels in Alberta and British Columbia.
  • Acted for construction companies in breach of trust and breach of contract claims on infrastructure projects in Ontario.

Reported Decisions

  • Full success at trial defending a real estate agent and brokerage. The plaintiffs were unsuccessful in advancing a conversion claim, which was dismissed. The plaintiffs had no legally enforceable right or interest against the defendants. Instead, they ought to have advanced a constructive trust claim but failed to do so.   • Successful summary judgment motion over a disputed loan security guarantee. The defendant’s arguments that she did not receive independent legal advice prior to providing security for the loan were not accepted. Eckert v. U.S. Trust Corp. II et al, 2014 ONSC 3357
